Care in Mind funded services policy

1. Purpose

This policy outlines the guidelines for report writing and the release of legal documentation. It clarifies that we only release documents to the court or legal entities if mandated by a subpoena or court order. Participation in therapy does not involve the automatic provision of such documents, as they are created solely for therapeutic purposes and may contain sensitive information.

2. Scope of Care in Mind Services

Care in Mind covers the cost of therapy sessions provided for mental health support. This funding is limited to therapeutic services and does not extend to the preparation of external reports, legal documentation, or paperwork requested for non-clinical purposes.

3. Requests for Reports and Documentation

We do not provide letters, reports, or documents to external parties without your written consent. This includes, but is not limited to:

  • Legal reports,
  • Court-ordered assessments,
  • WorkCover reports,
  • Insurance reports, or
  • Any external documentation required for non-therapeutic reasons.

These requests fall outside the services covered by Care in Mind and are subject to specific guidelines.

4. Handling Subpoenas, Court Orders, and Community Safety

In cases where a valid subpoena or court order is presented, we are legally obligated to release the requested documents. We will comply with legal requirements, but it is important to note that therapy notes are created for internal therapeutic purposes and may contain sensitive information not suitable for legal proceedings.

If there are concerns about potential risks to the safety of you, others, or the community, we may release relevant information to a third party without your consent to ensure the safety of all involved, as required by law.

5. Client Awareness and Communication

At the start of therapy, clients are informed that only therapeutic services are covered. Any requests for external reports or documentation will require the client’s written consent and will be processed only if mandated by legal authorities. This ensures transparency and avoids misunderstandings.

6. Request Process

All requests for documentation must be submitted in writing and clearly state the purpose of the report or document. We do not release any documents to external parties without your written consent, except when legally mandated or required for community safety concerns.

7. Exceptions

In emergency situations, or when mandated by a court order or in the interest of community safety, we will release documents as required by law, following legal protocols.
